5. WARRANTY - LIABILITY

5.1 LIMITED WARRANTY
LIMITED WARRANTY
TAP MIND THE MAP LIMITED warrant that, for a period of three hundred and sixty six days from the date shown on your receipt, the CONTENT will perform substantially in accordance with instructions, notes, terms and conditions as specified by TMTM.
TMTM does not warrant that the software and content will be uninterrupted or that the content or software shall be error-free. In using the CDRP-S you accept all risks as to the quality and performance of the CDRP-S.
Any TMTM FREE elements within the CDRP-S have no warranty or technical support available unless you purchase a technical support agreement.
For SOFTWARE warranties refer to respective Software House, or, your Software Distributor, or, Terms and Conditions within the CDRP-S.
Some jurisdictions do not allow limitations on duration of an implied warranty, so the above may not apply to you.
5.2 CUSTOMER REMEDIES
CUSTOMER REMEDIES
With respect to the warranty for the CONTENT and physical CDRP-S, TAP MIND THE MAP LIMITED's entire liability and your exclusive remedy shall be, at TMTM's Option, a) refund of the price paid or b) repair or c) replacement of CDRP-S. Subject to the original CDRP-S sold to you is returned to TMTM with a copy of your receipt.
This Limited Warranty is void if failure of the CDRP-S has resulted from accident, abuse, inappropriate storage, misapplication or any cause other than faulty production by TAP MIND THE MAP LIMITED. Any replacement CDRP-S will be warranted for the remainder of the original warranty period or sixty (60) days, whichever is longer.
5.3 NO OTHER WARRANTIES
NO OTHER WARRANTIES
To the maximum extent permitted by applicable law, TMTM disclaim all other warranties either express or implied, including but not limited to, implied warranties of completeness, accuracy, merchantability, quality and fitness for a particular purpose, with regard to the CDRP-S and any accompanying printed materials. You accept that the CDRP-S and any accompanying materials are provided on an 'as is' basis. This limited warranty gives you specific legal rights. You may have others, which vary from jurisdiction to jurisdiction.
5.4 NO LIABILITY FOR CONSEQUENTIAL DAMAGES
NO LIABILITY FOR CONSEQUENTIAL DAMAGES
To the maximum extent permitted by applicable law, TAP MIND THE MAP LIMITED shall have no liability whatsoever for any consequential, incidental or special damages ( including without limitation, damages for loss of business profits, business  interruption, loss of business information, or any other pecuniary loss ) arising out of YOUR use of or inability to use the CDRP-S, or due to incompatibility between YOUR System and the CDRP-S. even if TMTM has been advised of the possibility of such damages.
5.5 IN NO EVENT...
In no event shall TMTM's liability under this agreement exceed the amount of the Licensee Fees actually paid by you in respect of the CDRP-S purchased giving rise to the claim. The foregoing limitation shall apply notwithstanding any failure of essential purpose of any limited remedy.
